Ex drafted and delivered to lawyer separation agreement to give her 2/3 of assets.
Ex canceled agreement, quit her job to get a legal aid lawyer.
Our lawyer Peter Kennedy warned she won't get as much in court.
1996.
Followed other family trials for research through to 1999 during a 50 50 survival chance of cancer recovery. Committed my share of the sale of the property to cover any child support I might miss during treatment and recovery from surgery even though child support payments are forgone during life threatening illness.
Became disgusted at the level of child harming corruption in family court and the complete lack of notice by the courts in the best interests of the child.
1997.
Thornton lied to judge, said I told kids to run away or they would never see me again when in fact they we running away from the beatings.
Unlawfully attacked by FMEP conducting illegal poison pen campaign resulting in going from top of rehire to no rehire list.
Arrested for sitting in my car in the street waiting for my kids on a court ordered visitation day by a married cop that took my ex to a housewarming party. RCMP member Widden said I was breaching the peace so I spent the night in cells even though no bond existed. Widden states he feared my 150 lbs would jump out of my car, bust through two 6' cops and run up 40 feet of driveway before my ex could go the 10 feet from house to car. Baker interview answers question to Widden if I ever hit her, she replied "no he has never even threatened me". Widden submits doctored statement of fictitious events of abuse. After 4 months into the now issued 6 month peace bond Baker called me but I convinced her she had the wrong number. Even though she called me I would be back in cells if I spoke to her. The peace bond was a well executed hatchet job that helped Thornton separate me from my kids so he could separate my kids from their child support. As I had a custody hearing I had the peace bond covering my children dropped and requested the one Baker initiated be extended indefinitely, the judge declined.
Sentenced to 2 weeks for contempt of court. I sold heavy equipment that under common law I owned outright but filed the paper work in the wrong order. Legal Aid lawyer ThorNton playing the unjust enrichment card 2 hearings,,, and he lost both but managed to enrich himself with child support in 99 ex parti hearing.
Widden sends RCMP log detectives to my house to investigate a log theft but even though the tire tracks at the scene didn't match any equipment I had the attempted intimidation still lasted an hour.
Filed theft complaint with forged checks, mail drop boxes for company checks, cash withdrawals that disappeared and out of province bank account in company name, in brothers back yard.
Desperate to conceal the RCMP involvement crown responded it was OK for a business partner to steal from the other. Business partner then transfers limited company assets to wife's name, not considered arms length.
1998.
RCMP member Nigel Marsh as a person of interest in major theft given false alibi by detachment, blamed theft on me but I was in hospital with cancer and the evidence used was proven totally false. I suspect Rick Widden also started the alibi story to hide the RCMP person of interest involvement.
Federal report, 'for the sake of the children'.
Joined international shared parenting group in support of the children of divorce.
Divorce trial. No lawyer, no allowed to speak or present evidence. In writing appeal denied, "judge heard enough from ex to make decision".
1999.
Discovered teacher shook my son twice causing headaches for days because he was so upset about not seeing me.
Federal minister of justice vows to follow federal justice committee recommendations to eliminate sole custody as per report.
Ujjal Dosanjh states "we must pay more attention to the children of divorce". Followed by 3 years of record high sole custody and paid child support, regardless ole custody climbs to record high followed by record child poverty.
Ex Parti hearing turns all, including my 50% proceeds of assets over to plaintiff, includes the amount of child support and my court costs. Legal aid lawyer pockets $24,000 in child support or plaintiff lied to FMEP leaving me in arrears. Third year of following other family trials. Kicked off program 'no justice no investment'.
2000.
I moved away to protect my kids, to stop them asking to see me that lead to the physical abuse, beaten to the ground because they asked to see me.
Hit with life altering depression.

2002.
Data sets show the increase in sole custody was mainly based within the child support claw back cases that generated maximum revenue to fill government pockets.

Moved back, physical abuse restarted, multiple abuse charges requested by one of the children but I'm threatened by child abuser judge Grist.
Child assaulted in court house in front of RCMP, she took no action taken even though I requested it.Sheriff forcible returned child to abuser.

Child support is not for the children.
If there is even a whiff government can pocket the child support it is sole custody and child support 100% of the time. By the facts the Canadian family court is tax bias, exploding the myth the courts are gender bias. By the facts the courts use sole custody to generate revenue and consequently have doubled the child poverty rate to 1 in 5,,, in a decade, all in a top G-8 economy with 90% of child support paid.
The government says forcing hundreds of thousands of children to grow up in poverty is legal, and they should know they wrote the laws.

B.C. abandons child support claw back in budget

The decision means, starting Sept. 1, single parents on income or disability assistance can keep the full amount of child support payments received by ex-partners, without surrendering any income back to the province (state).
I dubbed this clawback practice as the non-custodial parent tax, NCPT, in 2002 while the last 5 years has provided the undisputable results,,,, and it is just making it to the talks postponed stage,,,, for a handful of the children.
The 1 in 10 child poverty rate to 1 in 5 in a decade, results of pocketing the child support paid for our most vulnerable children, cant be ignored when poverty is the leading youth indicator to a criminal lifestyle.
It's not irony that an award created to honour people saving others from abuse is awarded to a person that has abused so many children.

From at least 1999 to 2002 the government was well aware of the data predicted outcome of the total lack of the best interests of the child by the courts. The results were becoming apparent with a warning the problem will grow past the point of ignoring it. By 2007 a high crime rate area cooked the crime statistics to hide the results.
The pot is boiling with accountability that includes the last government. Interesting ties between the NDP, BC Hydro and the current governments push for site C dam.

The benefits of ending the governments child support claw back program will have several effects. More mothers, not a lot, forgoing the minimum wage jobs that allow them to keep the child support preferring full time parenting. That will benefit the children as well as the problematic youth employment.
ReplyDeleteStudies indicate a notable percentage would pay more support if the money went to the children, certainly less acrimony meaning better overall parenting.
For credit the government is portraying ending claw backs as another responsible act rather than address the circumstances that forced them to give up this revenue stream. The opposition will remind us they took issue with claw backs last year but again circumstances are the driving force so they deserve no credit for being a dollar short and a decade late.
The circumstances dictated the change, not some leap to good government or an excursion into attracting votes and certainly not my chronicling the detrimental effects of ignoring the best interests of the child. Child abuse, denied access, false allegations, and PAS that are all based on winning child support will be weakened by ending claw backs but circumstances will for more change.
I've been retired by my readership so good luck with the rest of the mess.

Given the 15 year history of persecution for defending the children of divorce I have no doubt the remaining hoops I've been told to jump through are too high and as feeble as the excuse is they will use it.
ReplyDeleteAfter 15 years of campaigning against child support claw backs BC is ending the practice. As insignificant as BC is on the national and certainly the international front for the children of divorce it is by far, measured by any standard, the most significant advancement in the last 20 years internationally.
It would be foolish for me to expect any other breakthroughs on the best interests of the child as claw backs rank just below sole custody. For that reason I find it time or rather lack of that prompts me to publish the long awaited by many the promised book, Father Denied. Child poverty and youth in trouble.
Cooking the crime rate in 2007 to hide the results of government pocketing child support is having consequences. 2009 saw record property crime that attracted the largest number of gangs per capita of anyplace globally in 2010, as this from a 1 in 10 child poverty rate. The rate announced in 2009 increased to 1 in 7 with the last reported increased to 1 in 5.

How big a deal is ending child support claw back.... it is 10 times bigger than announced...
BC provincial government numbers. 50,000 single parents with 100,000 children on welfare, 16,500 payors in arrears for a total of $17,000,000/year with the claw back affecting 5500 children or $257/month/child.
Federal numbers. 87% of child support paid.
50,000 minus a very over estimated 20% that don't know who to name as payor leaves 87% of 40,000 as payors or 34,800, times 2 children,,, @ $257/month is almost $18 million a month, $216 million a year and not the declared $17 million a year.
50,000 minus the 20%, minus the 16,500 declared in arrears ( but not necessarily not paying) is 23,500 times 2 children @ $257 is still $12 million a month or still $144 million a year and not the declared $17 million a year.
Before all of these numbers were released I estimated $15 to $20 million a month from our 4 million population.
They are trying very hard to keep the true number of children affected by claw backs from the 70,000 by federal numbers and/or 47,000 by provincial numbers, not the 5500 stated by the BC government.
One explanation might be the $17 million per month was misinterpreted as over a year and divided by 12 to get the 5500 affected kids. The $17 million per month is right in the middle of my earlier estimate and 12 times 5500 is 66,000 almost estimate mid-range.
The reported 5500 vs the actual of times ten also ties into a 2007 article on Surrey cooking the crime rate to last years warning by both mayor and chief of police, 'don't walk the streets alone. even in the daytime'. The similarities and probable results of one could, and possibly should, be associated to the actual results of the other.

ReplyDeleteIn 2000 I fell asleep, dreamed, woke up and thought about my kids all day. Food made me nauseous while motivation down to the will to live was diagnosed as debilitating depression. The first 5 years was the worst although I still give little thought to tomorrow.
The system did everything they could to drive me past the will to live to the will to die, but having no will to live was a long way off having the will to die. They missed the fact I had maintained my ability to reason while affected with depression, and failed.
20 years later I have fought my way through depression, poverty and everything the system has thrown at me, and still not on my knees.
Someone should go to jail for doubling the child poverty rate in a decade.
